When purchasing a home or home site, a water supply that meets standards for both quantity and quality is necessary. Poor quality water or an inadequate supply of water can take the pleasure from country living.
Oregon Revised Statute 448.271 requires well testing in any exchange of
property.
“In any transaction for the sale or exchange of real-estate that includes a dug, drilled or driven well that supplies ground water for domestic purposes the seller of the real estate shall, upon accepting an offer to purchase that real estate, have the well tested for nitrates and total coliform bacteria.”
The Health Division also may require additional tests for specific contaminants in an area of groundwater concern or groundwater management area.
The seller shall submit the results of the test required under this section to the Health Division. The seller may designate someone to complete the paperwork and submit the lab results (real estate agent, broker, attorney, etc.).
Only laboratories certified by the department shall be used to conduct the water tests required by these rules. Delta Environmental Services is certified for Real Estate testing. Contact us for more information about testing and prices.
